 Truck Accidents

Truck and automobile accidents are the leading cause of personal injury in the United States. According to the National Highway Traffic Safety Administration (NHTSA) 2,575,000 people were injured and 42,642 killed in motor vehicle crashes in 2006.

Ever-increasing numbers of vehicles on the road (especially large trucks), speeding, alcohol, distracted drivers, and unsafe road conditions are among the most common causes of these accidents.

Spohrer & Dodd has over thirty years of experience in successfully handling the serious injury and wrongful death claims that arise out of truck and automobile accidents. This litigation may go beyond a claim related to a basic accident and involve liability on the part of vehicle manufacturers, distributors, retailers, and other supplies for defects in the vehicle itself. It may also involve an action against governmental bodies when unsafe roadway design and maintenance is at the center of a motor vehicle accident.

Spohrer & Dodd is committed to maximizing the recovery for clients involved in truck and automobile accidents, whether by trial or settlement.  Motor vehicle accidents are often challenging and complex and do not fall within a simple category. They may involve a client with pre-existing conditions, soft tissue injuries and multiple care providers. Frequently, the most challenging aspect of a motor vehicle accident claim is finding insurance coverage that is sufficient to fully compensate the injured person.  Our team of attorneys has the skill and resources to address these challenges and to identify all possible defendants, insurance coverage and avenues of recovery.

Large Trucks – Ever Present Highway Hazard

The operation of trucks is governed by state motor vehicle codes and federal standards, as set by the Department of Transportation. These regulations cover all areas of operation, including: loading, lighting, driver licensing and certification, duty time parameters, etc. operation. Despite these codes and regulations, accidents involving trucks occur with frequency and devastating results.

NHTSA’s 2006 Traffic Safety Report cites the following statistic related to collisions involving large trucks:

Truck Accidents

  • In 2006, 385,000 large trucks (gross vehicle weight rating greater than 10,000 pounds) were involved in traffic crashes in the United States; 4,732 were involved in fatal crashes.

  • A total of 4,995 died as a result of those accidents; this represents one out of nine traffic fatalities.

These statistics clearly demonstrate the unique danger posed by the semi-trucks that increasingly crowed our nation’s roadways. When an 18-wheeler hits a car or smaller truck, the driver of the passenger vehicle is almost always seriously injured.

Truck-involved accidents usually result in injuries that require a long and painful rehabilitation period. Recovery in semi-truck-caused accidents frequently usually requires a claim against the truck driver’s auto insurance policy as well as the trucking company’s commercial liability policy.
