Attorney Robert Spohrer Spoke at FJA 2019 Ski Seminar About Comparative Negligence

Attorney Robert Spohrer of Spohrer Dodd in Jacksonville, Florida recently had the opportunity to act as a keynote speaker during the Florida Justice Association (FJA) 2019 Ski Seminar in Park City, Utah. The FJA took continuing legaleducation (CLE) courses to the next level of engagement and enthusiasm by hosting the event at the wonderful Westgate Park City Resort & Spa. Attendees were able to hit the slopes and advance their legal knowledge during the multiday seminar, which lasted from January 18^th to the 21^st.

The FJA invited Robert to share his knowledge about strategies for defeating comparative negligence defenses during his dissertation of “Machine Guarding Litigation: Defeating the Operator Error Defense.” A significant portion of many insurance defense arguments, both in and out of court, relies on trying to put most of the blame for an accident on the plaintiff. In some circumstances, if the plaintiff can be proven to be mostly at-fault for their injuries, then they lose entitlement to any recovery from the defending parties.

Attorney Robert Spohrer explored how defense firms generally craft comparative negligence defenses, and what a proactive injury attorney can do to shut them down. In particular, he focused on how comparative negligence arguments ultimately come into play during work injury cases involving a plaintiff who was hurt due to a lack of machine guarding. Defense firms will argue the operatorshould have known the danger of the machine in use, and so proper machine guarding is only a secondary precaution behind a general sense of safety. All in attendance for his dissertation learned through Robert’s discussion and experiences how to counteract these arguments and move their clients’ cases forward.
